Terms of Service

1. Overview

Gifts2Me ("Gifts2Me," "we," "us," or "our") is a platform that enables creators to publish wishlists and allows supporters ("Gifters") to send gifts to creators using third-party payment providers.

Gifts2Me does not process payments, hold funds, act as a wallet, or provide escrow services. All payments are processed by independent third-party payment providers.

By accessing or using Gifts2Me, you agree to these Terms of Service.

2. Eligibility

You must be at least 18 years old to use Gifts2Me. By using the platform, you confirm that you meet this requirement.

3. Role of Gifts2Me

Gifts2Me acts solely as a facilitation platform.

• We provide tools for wishlist creation and gift coordination.
• We do not own, control, or guarantee creator content.
• We do not custody funds or digital assets.
• Digital gift items are fulfilled instantly at checkout; no further delivery or fulfillment applies.

4. Payments & Fees

Payments are processed through third-party providers:

• Card payments are processed by Stripe
• Cryptocurrency payments are processed via smart contract on the Base network

Platform Service Fees

Gifts2Me charges a platform service fee on each successful gift. All fees are paid by the gifter, not the creator.

Card Payments (Stripe):

• Platform fee: 8% of the gift amount + 0.50 in the transaction's native currency

Cryptocurrency Payments (USDC on Base):

• Platform fee: 6% of the gift amount + 0.30 in the transaction's native currency

Additional Fees

• Stripe charges standard credit card processing fees
• Cryptocurrency payments incur blockchain network gas fees (paid in ETH on the Base network)
• These fees are set by the payment provider or blockchain network and are shown to users before completing payment

Non-Custodial

• Gifts2Me never holds customer or creator funds, private keys, or seed phrases
• Gifts2Me does not set or control currency exchange rates
• Gifts2Me does not control payment authorization decisions or transaction reversals

5. Cryptocurrency Payments

5.1 How Cryptocurrency Payments Work

Cryptocurrency payments on Gifts2Me use a non-custodial smart contract deployed on the Base network (an Ethereum Layer 2 blockchain). Payments are made in USDC (USD Coin) only.

When a gifter sends a crypto gift, a single transaction is submitted to the creator's personal payment splitter contract. The smart contract atomically and simultaneously:

• Sends the full gift amount directly to the creator's Base wallet
• Sends the platform fee to Gifts2Me

There is no separate fee payment, no two-step process, and no payment window to complete. The entire transaction settles in a single blockchain confirmation.

5.2 Supported Cryptocurrency, Network, and Currency Conversion

Gifts2Me currently supports:

• Currency: USDC (USD Coin) only
• Network: Base mainnet (Ethereum Layer 2)

Gifters must have USDC on the Base network in a compatible wallet (such as MetaMask or Coinbase Wallet) to complete a crypto gift. Sending other currencies or using other networks is not supported and may result in permanent loss of funds.

Currency Conversion: Gift amounts denominated in non-USD currencies (such as GBP, EUR, or others) are converted to USDC at the live exchange rate at the time of transaction initiation. Exchange rates are sourced from CoinGecko and may fluctuate. The exact USDC amount — including the converted gift amount, platform fee, and total — is displayed in full to the gifter before they confirm the transaction. The rate is refreshed automatically at the moment of confirmation to ensure accuracy. Gifts2Me is not responsible for minor rate fluctuations between the time the rate is displayed and the time the transaction is confirmed on-chain.

Gifts2Me reserves the right to add or remove supported currencies and networks at any time.

5.3 Non-Custodial Nature

Gifts2Me operates as a strictly non-custodial platform for cryptocurrency payments. This means:

We do NOT:

• Hold, store, or have access to any cryptocurrency sent as gifts
• Control or have access to private keys for any user wallets
• Act as an intermediary holding funds between gifter and creator
• Have the ability to reverse, cancel, modify, or refund cryptocurrency transactions once confirmed on-chain
• Provide cryptocurrency wallet services

Payment flow:

• Gifter's wallet → Smart contract → Creator's wallet (gift amount) + Gifts2Me wallet (platform fee)
• All splits happen atomically in a single on-chain transaction
• Neither party acts as a custodian at any point

Our role is limited to:

• Deploying and maintaining the smart contract infrastructure
• Providing the web interface for initiating transactions
• Collecting our platform fee as part of the smart contract split

5.4 Blockchain Transparency

All cryptocurrency transactions on Gifts2Me are recorded on the Base blockchain and are publicly visible. This includes transaction amounts, wallet addresses, and timestamps. By using crypto payments, gifters and creators acknowledge that their on-chain activity is publicly accessible to anyone.

Gifts2Me does not control or limit the public visibility of on-chain data.

5.5 Refund Policy for Cryptocurrency Payments

Cryptocurrency transactions are irreversible by design. Once a transaction is confirmed on the Base blockchain, it cannot be reversed, cancelled, or refunded by Gifts2Me under any circumstances.

Exception for Verified Technical Failures:

If a transaction fails due to a verified technical error in Gifts2Me's smart contract or platform infrastructure, and funds are not delivered as intended, you may contact us to request a review.

• Contact contact@gifts2me.com within 24 hours
• Provide the transaction hash, wallet address, amount, and description of the issue
• Refund decisions are made at Gifts2Me's sole discretion after investigation
• Approved resolutions are processed within 5–10 business days

5.6 Network Fees (Gas)

Cryptocurrency transactions on the Base network require a small gas fee paid in ETH to cover blockchain network costs. These fees are:

• Set by the Base network, not by Gifts2Me
• Paid by the gifter in addition to the gift amount and platform fee
• Shown in the gifter's wallet before confirming the transaction
• Non-refundable regardless of transaction outcome

Gifters must have a small amount of ETH on the Base network in their wallet to cover gas, in addition to the USDC required for the gift.

5.7 Creator Responsibilities

Creators who enable cryptocurrency payments agree to:

• Provide an accurate and valid Base network wallet address
• Be solely responsible for the security of their wallet and private keys
• Understand that funds sent to an incorrect wallet address cannot be recovered by Gifts2Me
• Self-custody any USDC received and manage their own wallet security
• Comply with all applicable tax reporting and regulatory requirements for cryptocurrency income in their jurisdiction

5.8 Gifter Responsibilities

Gifters who use cryptocurrency payments agree to:

• Verify all payment details before confirming any transaction
• Understand that cryptocurrency transactions are irreversible once confirmed
• Ensure they have sufficient USDC on the Base network to complete the gift
• Ensure they have sufficient ETH on the Base network to cover gas fees
• Use a compatible wallet (MetaMask, Coinbase Wallet, or equivalent)
• Comply with all applicable laws and regulations regarding cryptocurrency transactions

5.9 Platform Limitations

Gifts2Me is NOT responsible for:

• Lost or misdirected funds due to incorrect wallet addresses provided by creators
• User error in initiating or confirming transactions
• Fluctuations in USDC or cryptocurrency values
• Exchange rate movements between the time the rate is displayed and the time the transaction confirms on-chain
• Gas fees or Base network congestion delays
• Issues with third-party wallets, exchanges, or browser extensions
• Creator failure to secure their wallet or access received funds
• Regulatory changes affecting cryptocurrency in any jurisdiction
• Smart contract interactions initiated outside of the Gifts2Me platform

6. Identity Verification

Creators may be required to complete identity verification through third-party providers (such as Stripe) to comply with legal and regulatory requirements.

Third-party payment processors may also require identity verification from gifters to comply with financial regulations, anti-money laundering laws, and know-your-customer requirements.

Gifts2Me does not perform identity verification directly and does not store identity verification data collected by payment processors.

7. Prohibited Use

You may not use Gifts2Me to:

• Violate any applicable law or regulation (including anti-money laundering, counter-terrorist financing, sanctions, or tax laws)
• Engage in fraud, deception, or chargeback abuse
• Launder money or conceal the source, ownership, or destination of funds or assets
• Support, fund, or promote terrorism or any individual or organization subject to economic sanctions
• Sell or facilitate illegal or highly regulated goods or services
• Create, sell, or promote child sexual abuse material, sexual exploitation, or non-consensual intimate content
• Use Gifts2Me as an exchange, remittance service, or investment/trading platform
• Circumvent or attempt to circumvent the rules, policies, or monitoring of Stripe or any other payment provider we integrate
• Harass, threaten, or exploit others
• Misrepresent your identity or affiliation, or operate scams, phishing, or impersonation schemes
• Provide fake or fraudulent cryptocurrency wallet addresses
• Use cryptocurrency payments to evade taxes or financial reporting requirements
• Violate sanctions or export control laws through cryptocurrency transactions
• Interact with Gifts2Me smart contracts in unauthorized or malicious ways

We reserve the right to suspend or terminate any account engaged in, or suspected of engaging in, prohibited activity and may share information with payment providers or law enforcement where required.

8. Payment Provider Compliance

Use of Gifts2Me is subject to the rules and policies of integrated payment providers:

• Stripe (for card payments)
• Base network / smart contract infrastructure (for cryptocurrency payments)

Creators and gifters agree not to engage in activity that would cause Gifts2Me or its payment partners to be in violation of applicable regulations or provider policies.

9. Creator Conduct & Gift Framing

Creators using Gifts2Me may not represent, imply, or promise that a gift will result in the delivery of goods, services, access, interaction, content, or any other benefit in return.

Gifts must not be framed as conditional, transactional, or required to unlock content, communication, experiences, or outcomes.

Creators may express gratitude for support but may not advertise gifts as purchases, payments, tips for services, or exchanges of value.

Gifts2Me reserves the right to suspend or remove creators who violate these rules.

10. Refunds & Disputes

Card Payments

Refunds and chargebacks for card payments are governed by Stripe's policies. Gifts2Me does not issue refunds directly.

Cryptocurrency Payments

Cryptocurrency transactions are irreversible by design and are non-refundable once confirmed on the Base blockchain.

Platform fees may be reviewed only in cases of verified technical failure on Gifts2Me's platform (see Section 5.5).

11. Limitation of Liability

Gifts2Me is not liable for:

• Payment failures or processing errors
• Creator behavior, content, or actions
• Losses due to third-party services, wallets, or exchanges
• Blockchain transaction errors or delays
• Cryptocurrency price volatility or value fluctuations
• Lost, stolen, or misdirected cryptocurrency
• Incorrect wallet addresses provided by creators or gifters
• User error in sending or receiving cryptocurrency
• Exchange rate movements between display and on-chain confirmation
• Gas fees or network delays
• Regulatory changes affecting cryptocurrency

To the maximum extent permitted by law, our total liability for any claims shall not exceed the platform fees paid to Gifts2Me for the specific transaction in question.

12. Tax Reporting

Creators

Income received through Gifts2Me (via card or cryptocurrency payments) may be taxable. Creators are solely responsible for determining applicable taxes, reporting income, paying taxes owed, and maintaining adequate records.

Gifters

Gifts, including cryptocurrency gifts, may have tax implications. Gifters should consult tax professionals regarding their obligations.

Gifts2Me's Role

Gifts2Me does not provide tax advice. We may provide transaction records to assist with tax reporting, but creators and gifters are responsible for their own tax compliance.

13. Intellectual Property

Creators retain all rights to their usernames, profile images, wishlist content, and other materials they upload to Gifts2Me.

By using Gifts2Me, creators grant us a limited, non-exclusive license to display their content on the platform for the purpose of facilitating gifts.

Gifts2Me and its logos are trademarks of Gifts2Me. You may not use our branding without express written permission.

14. Account Termination

Gifts2Me reserves the right to suspend or terminate any account at any time for:

• Violation of these Terms of Service
• Violation of payment provider policies
• Fraudulent, illegal, or prohibited activity
• Risk to platform integrity, security, or reputation
• Failure to comply with identity verification requirements

15. Dispute Resolution

Any disputes arising from use of Gifts2Me shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

16. Changes to Terms

We may update these Terms of Service at any time without prior notice. Updated terms will be posted at gifts2me.com/terms with a new "Last Updated" date.

Continued use of the platform after changes are posted constitutes acceptance of the updated terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of North Carolina, USA, without regard to its conflict of law provisions.
